Abstract

ÖZET Bu tezi yapmadaki amacımız cuma namazının vücup ve sıhhat şartları ile mezheplerin bu şartlar üzerindeki görüş ve delillerini incelemektir. Cuma namazının farz oluşu, mezhepler arasında ittifakla kabul edilen bir husustur. Ancak cuma namazının vücup ve sıhhat şartları hususunda aynı ittifak yoktur. Cuma namazının vücup şartları; Müslüman, âkil, baliğ, erkek, hür, mukim olmak ve cuma namazını kılmaya engel bir özrü olmamaktır. Bu şartlar Kur'ân ve sahih hadislere dayandığından mezhepler arasında ayrıntılar hariç ihtilaf mevzuu olmamıştır. Cuma namazı kılınacak yerin şehir veya şehir hükmündeki bir yerleşim yeri olması, namazı, devlet başkanı veya naibinin kıldırması, cemaat, vakit, hutbe ve cumanın tek bir yerde kılınması, kılınacak yerin cami olması ise bu namazın sıhhat şartlarındandır. Bunlardan cemaat, vakit ve hutbe şartlarında ittifak vardır. Cuma kılınacak yerin cami olması ise yalnız Malikiler tarafından ileri sürülmüştür. Cuma namazının şehirde kılınması ve yine devlet başkanı veya naibinin izniyle kılınması, Hanefiler tarafından uzak te'vil yoluyla cumanın sıhhat şartları arasına dahil edilmiş, bu konuda Kur'ân veya Sünnet'ten doğrudan bir delile dayanılmamıştır. Cumanın tek bir yerde kılınması şartı ise, Kur'ân veya Sünnet'ten herhangi bir delile dayanmaktan çok, Hz.Peygamberin teamülüne ittibâ hassasiyetine dayanmaktadır. The obligatory of Cumu?a prayer is a matter of agreement among the schools. But, there is no agreement in respect of its necessary and validity conditions. The necessary conditions of Cumu?a prayer are, being wise, adult, man, free, settled and having no excuse preventing from to perform the prayer. As this conditions resting on Kur?an and valid hadiths, they haven?t been matter of dispute apart from the details. The validity conditions of Cumu?a prayer are, being of place which the prayer is performed in it a city or place equivalent to city, to be performed by the leadership of Imam (president) or his representative, congregation, time, sermon (khutbah), to be performed in one place, being of prayer place a mosque. Among these, the congregation, time and sermon conditions are agreed upon them.. The prayer place?s condition of being a mosque is, put forward by the Malikites. The Hanefites added the city condition and the permisssion of Imam or his representative to validity conditions by manner of explainig away, not by resting on any of evidence in Kur?an or Sunnah. The condition of one place is resting on the care about following the Prophetic practice rather than depending upon any indication in Kur?an or Sunnah.
