Abstract:
ÖZET İLK DEVİR İSLAM CEZA HUKUKUNDA HADD CEZALARININ İNFAZI İslam hukukunda mahkemece verilen ceza hükmünün infazı, ?hadd?, ?kısas- diyet? ve ?ta'zir? şeklinde ele alınır. Tezimizi işlerken, cezalar, hadd cezaları, infaz kavramı, hadd cezaları ve infazı ile infaz yerleri konularını sırasıyla ele alarak hadd cezalarının infazı hakkında topluca bir bilgiye ulaşmaya çalıştık. İslâm hukukunda cezalar suçlara göre farklılık arz eder. Hadd cezaları; miktarı ve sınırları daha önceden Allah tarafından taktir olunmuş, yüce yaratıcının kulları üzerindeki bir hakkı olarak algılanmıştır. Hadd cezalarını gerektiren suçların sayıları sınırlıdır ve nass ile sabittir. İnfaza başlayabilmek için mahkeme kararının kesinleşmesi gerekir. İslam hukukunda suçun sübutunu sağlayan ıspat yolları, kararın kesinleşmesi manası taşıdığından, bunları İslam ceza hukukunda infazın şartı olarak tespit ettik. Yine cezanın infazının meşruiyyet şartları arasında infazın kanuniliği, şahsiliği ve umumiliği kavramlarını tespit ettik. İslam ceza hukukunda bazı cezaların infazının şartlı olarak ertelenmesi mümkündür. Hz. Peygamber ?s.a.v? dönemindeki infazın gerçekleştirildiği yerlerin, sabit bir infaz mekanı değil de, duruma ve şartlara göre değişkenliği bulunan yerler olduğu kanısına vardık.
ABSTRACT THE EXECUTİON OF HADD PUNİSHMENTS İN THE EARLY PERİOD In Islamic Law, the execution of the punishment decided by the court can be classified as either of the three categories: hadd (canonical punishments), kısas (retaliation)-diyet (blood money) or ta'zir (correction). In our study, we tried to reach a comprehensive view about the execution of hadd punishments by examining, respectively, punishments, hadd punishments, the concept of execution, hadd punishments and their execution and the places of execution In Islamic Law, punishments vary according to the crimes. Hadd punishments are those of which their limit and boundaries are commanded by Allah and are seen as the right of the Creator over His servants. The number of crimes that require hadd punishments are limited and ordained by the Canonical sources. In order to start execution of a punishment, the decision of the court has to be made certain. Because the means and ways of proving the validity of guilt, in Islamic Law, also mean the establishment of decision in the court, we found out that they are also the requirements of execution in Islamic Penal Law. Also, we discovered the concepts as among the requirements of the legality of the execution of a punishment that the execution is lawful, individual and general. In Islamic Penal Code, it is possible to conditionally postpone the execution of some punishments We believe that the places where the execution was carried out during the time of the Prophet Muhammad were not some certain places of execution but were rather places varied according to situations and conditions.
