Abstract:
ÖZET Osmanlı mparatorluğunda III. Selim ile başlayan ilk ciddi reform girişimi, zaman zaman kesintiye uğramış olsa dahi Mustafa Kemal liderliğinde kurulan Türkiye Cumhuriyetine kadar devam etmişti. Bu reformlar iç ve dış baskılar sonucu oluşmuştu. Baskılar sonucu oluşan en önemli reformlardan biri hukukun modife edilmesi ve Anayasanın ilanıydı. Sened-i ttifak ile başladığı kabul edilen bu süreç, Tanzimat ve Islahat Fermanları ile devam etmişti. Ancak bunlar da istenilen sonucu vermemiş, Osmanlı Devletini içinde bulunduğu zor durumdan kurtaramamıştı. Bunun üzerine siyasi, idari, ve hukuki yapıda kanunlaştırma hareketine girişilmişti. Bunun sonucunda ilk Osmanlı Anayasası olan Kanun-i Esasi kabul edilmişti. Ancak yine aynı Anayasa dayanak gösterilerek Meclis kapatılmış ve otuz yıl sürecek meclissiz bir yönetim başlamıştı. 1909'da II. Meşrutiyet'in başlamasıyla 1876 Anayasasında bazı değişiklikler yapılarak demokratikleştirilmişti. Ülkenin işgali bu Anayasanın da uygulanmasına fırsat vermemiş, yeni kurulan Türkiye Devletinin ilk Anayasası olan 1921 Teşkilat-ı Esasiye Kanunu kabul edilmişti. 1924'te eksikleri giderilen bu Anayasa 20 Nisan 1924'te BMM tarafından kabul edilmişti. ABSTRACT The reforms started with Selim III (1789-1807) in the Ottoman Empire continued until the establishment of the new state under the leadership of Mustafa Kemal Atatürk. These were the result of the internal and the external pressures. One of the most important reforms was the modification of the laws and the enactment of the constitution. In this study, the first constitution of the Ottoman Empire known as 1876 Kanun-i Esasi is examined and compared with the first constitution of the successor state, Republic of Turkey. In order to give a background to the reader, Sened-i ttifak (Document of Agreement) and Islahat Fermanı (Edict of Reform), the preliminary attempts for a modern and western style constitution is also studied.
