6360 sayılı kanunun kırsal gelişime etkisinin incelenmesi:Van Büyükşehir Belediyesi örneği / Investigating the impact of the law numbered 6360 on rural development: Van Metropolitan Municipality case

Abstract

6360 sayılı yasanın 2012 yılında yürürlüğe girmesiyle birlikte yerel yönetim alanında bazı değişiklikler yapılmıştır. Yasa ile beraber kırsal alana hizmet götürme yetkisi büyükşehir belediyelerine devredilmiştir. Bu çalışma ile 6360 sayılı yasanın kırsal alanda bir değişim-dönüşüm yaratıp yaratmadığı anlaşılmaya çalışılmıştır. Çalışmada temel amaç; yasanın olumlu veya olumsuz yönlerini ortaya koymak, yasanın eksikliklerine değinmek ve yasanın kırsal alanda nasıl bir etki yarattığını ortaya koymaya çalışmaktır. Yasa çıktığı ilk günden bu yana eleştirilere maruz kalmıştır. Bu çalışma ile yapılan eleştirilerde haklılık payının var olup olmadığı, ayrıca yasanın geliştirilmesi gereken yönleri var mıdır, kırsal alanda göçe sebep olmuş mudur gibi sorular ile eleştirilerin haklılık payları anlaşılmaya çalışılmıştır. 6360 sayılı yasanın hem olumlu hem de olumsuz yönlerinin olduğu, bazı hizmetlerde belediyenin yeterli, bazılarında ise yetersiz kaldığı görülmüştür. Ayrıca kırsal alanda bir göç olgusunun var olduğu fakat bu olgunun tamamı ile yasadan mı kaynaklı olduğu net anlaşılamamıştır. Göç olgusunun daha net anlaşılabilmesi için biraz daha zamana ihtiyaç vardır. Sonuç olarak yasanın kısmen de olsa olumlu yönlerinin olduğu ve yapılacak bazı yasal düzenlemeler ile yasanın eksik yönlerinin giderilmesi gerektiği fikri belirmiştir. Since the law numbered 6360 came into force in 2012, some changes have been made in the field of local government. Along with the law, the authority to provide services to rural areas has been transferred to metropolitan municipalities. In this study, it was attempted to determine whether the law numbered 6360 created a change-transformation in rural areas or not. The basic aim of this study is to mention the positive and negative aspects of the law, to reveal the shortcomings of it and to try to show how the law has an impact on the rural area. The law has been criticized since it was enacted. In this current study, it was aimed to understand whether there was a justifiable share in the criticisms made before. Besides, it was attempted to find out whether the law had any aspects that need to be developed or whether there was a reason in the rural area to immigrate. It has been observed that the law numbered 6360 had some positive and negative aspects, for instance; municipality had been sufficient in some services while it remained incapable in some others. Besides, there is a migration phenomenon in rural areas; however, it is not clear that if it is entirely because of the law or not. It might take more time to get a clearer understanding of the immigration phenomenon. It was found that there were partial positive aspects of the law, and as a result, the idea of eliminating the missing aspects of the law through some legal regulations emerged.
