Abstract:
Çalışmamızın temel konusu, İslam Hukuku'nda maraz-ı mevt halinde yapılan tasarruflardır. Ölüm hastalığı, ehliyet arızalarından biri olduğu için birinci bölümde; ehliyetin tarifi, nevileri, merhaleleri ve arızalarından bahsetmeyi gerekli gördük. Ölüm hastasının herhangi bir tasarrufta bulunurken kötü niyetli olabileceğine ve tasarruflarının kısıtlanması gerektiğine, İslam Hukuku'nda yer alan sedd-i zerâi, hakkın kötüye kullanılması, iç irade-dış irade uyuşmazlığı gibi ilkelerden hareket ederek ulaştık. Bu sebeple ikinci bölümde, bu ilkelere yer vererek üçüncü şahıslara nasıl zarar verildiğini ve bu durum karşısında İslâm Hukuku'nun izlediği yöntemi anlatmış olduk. Üçüncü bölümde ise çalışmamızın ana konusu olan ölüm hastasının tasarruflarına yer verdik. Bu çerçevede; ölüm hastasının ivazlı akitler, teberru akitleri, ikrar, evlenme, boşanma tasarruflarını ele aldık.
The main topic of our study is the validity of some conducts carried out in Islamic Law in the case of illness of death. Since the illness of death is one of the competence problems, we thougt that it is necessary to mention the definition, types, stages and problems of competence. We concluded through the principles of Islamic Law such as, sadd al-dharia bad use of the rights, the disharmony of inside will and outside will that the sickness of death could have bad will while doing any conduct ,hence his conducts must be limited. For this reason we explained in the second part these princeples and explained how the third parties are given harm and what method Islamic Law follows in these situations. As for the third chapter,we touched the conducts of the sick of death, that is the main topic of our study. In this framework, we dealt with the onerous contract, charity contract, admitted statement, marriage, divorce of the sick of death.
