Abstract

ÖZET Kurumsal yapılanmaya son elli yılda geçen Türk Sosyal Güvenlik Sistemi aslında azımsanmayacak yol kat etmesine rağmen son yıllarda bir açmazın içine düşmüştür. Sistem bu haliyle Hazine katkısı olmadan ayakta duramayacak, dolayısıyla sürdürülemez durumdadır. Sosyal güvenlik sisteminin içinde bulunduğu açmazlara çözüm bulunması gereği uzun yıllardan beri tartışılmakla birlikte bu konuda 08.09.1999 tarih ve 4447 sayılı yasa ile ilk adım atılmıştır. Yasanın yürürlüğe girmesinden sonra her ne kadar özellikle SSK ve Bağ-Kur bakımından mali göstergelerde iyileşme gözlenmişse de bu iyileşme kısa süreli olmuş, hem Emekli Sandığı'nın var olan problemlerine kalıcı çözüm bulunamamış, hem de SSK ve Bağ- Kur'un düzelmekte olduğu gözlenen mali yapıları Kasım 2000 ve Şubat 2001 krizlerinin de etkisiyle yeniden bozulmuştur. Sosyal Güvenlik Sistemi'nin yeniden yapılandırılması çalışmaları çerçevesinde Çalışma ve Sosyal Güvenlik Bakanlığı'nca ilgili kurum ve kuruluşların katkısıyla hazırlattırılan reform taslağı kamuoyunun tartışmasına sunulmuştur. Tek çatı yaklaşımının altyapı ve finansman eksiklikleri nazara alındığında mevcut kurumların özerk yönetime kavuşturularak ıslahı ve sistemin sürdürülebilir olmasının önündeki sorunlara birebir ve kalıcı çözümler getirilmesi, hem daha ekonomik hem de daha işlevsel olacaktır. SUMMARY Turkish Social Security System that has been in institutional formation for recent fifty years in fact has improved very much but in the last years it is in a dilemma. System, with these circumstances, can not stand consequently; can not go on without Treasury contribution. The requirement to find out solution to the dilemmas of Social Security System has been argued for many years, first step for this subject was the law dated on 08.09.1999 and numbered 4447. As the law has came into force there was a recovery especially in fiscal aspects of Social Insurances Institution (SSK) and Bağ-Kur, but this recovery lasted short. Also the existing problems of Pension Fund could not be solved permanently, and the fiscal problems of Social Insurances Institution and Bağ-Kur that seemed to be well went to bad again with the influence of the crisis of November 2000 and February 2001. In the re-formation studies of Social Security System the outline of reform prepared by Ministry of Labour and Social Security with the help of relevant and institutions has been put in the discussion of public opinion. Taking into the consideration of deficiencies of infrastructure and financing of the one-roof approach the amelioration of the existing institutions by autonomous management and to find out permanent solutions to all of the problems to carry on the system will be more economical and more functional.
